Terms of service
These Terms of Service apply to purchases made through the DOXAVIA online store and, where relevant, to the use of our website and related services.
When you place an order with DOXAVIA after these Terms have been made available to you before purchase, your agreement with DOXAVIA is subject to these Terms to the extent permitted by applicable law.
Nothing in these Terms limits or excludes mandatory consumer rights that cannot legally be limited or excluded.
1. About DOXAVIA
The online store is operated by:
DOXAVIA
Sole proprietorship registered in the Netherlands
Business address: [DOXAVIA BUSINESS ADDRESS – ADD BEFORE LAUNCH]
Chamber of Commerce (KVK) number: 42158450
VAT identification number: [DOXAVIA VAT ID – ADD BEFORE LAUNCH]
General customer service: support@doxavia.com
Returns, withdrawal, cancellations, exchanges and refunds: returns@doxavia.com
Website: www.doxavia.com
Additional mandatory business and contact information, including our business telephone number and availability, will be made clearly and easily accessible on our online store before the store becomes publicly available for purchases.
2. Scope of these Terms
These Terms apply to purchases made through the DOXAVIA online store unless different terms have been expressly agreed.
Other DOXAVIA policies may also form part of the information and conditions applicable to your purchase, including:
- our Return and Refund Policy;
- our Shipping Policy;
- our Privacy Policy; and
- product-specific terms, warnings or information displayed before purchase.
If any provision of these Terms conflicts with mandatory consumer law, the mandatory legal rule will prevail.
3. Customer information and authority to order
When placing an order, you must provide accurate, current and complete information that is reasonably necessary to process, pay for and deliver your order.
You are responsible for reviewing information such as your email address, delivery address and billing information before submitting your order.
If you are a minor, you may make a purchase only to the extent that this is permitted independently under applicable law or with any consent required from your legal representative.
4. Products and product information
DOXAVIA aims to provide clear, accurate and up-to-date information about products offered through our online store.
Product photographs and other visual representations may be illustrative. Minor variations in color or appearance may occur because of screen settings, manufacturing variations, packaging changes or similar factors.
Before placing an order, you should review the product description, specifications, compatibility information, instructions, safety information and any other information relevant to your intended use.
Where specific safety warnings, age restrictions, instructions, manufacturer or responsible-person information, or other disclosures are legally required, DOXAVIA will provide them where applicable.
DOXAVIA does not intentionally make false or misleading statements concerning product availability, popularity, performance, characteristics or benefits.
If a product safety warning or recall becomes necessary, DOXAVIA will act in accordance with applicable product-safety law.
5. Prices, taxes, discounts and promotions
Prices are displayed in the currency applicable to the market or region selected in the online store.
For consumers, displayed prices include taxes where applicable law requires those taxes to be included in the consumer price.
Applicable shipping charges and other mandatory costs known to DOXAVIA will be disclosed before you complete your order where required by law.
Prices may change. A later price change does not affect a purchase agreement that has already been validly concluded.
Where DOXAVIA announces a price reduction or discount, the reference price will be displayed in accordance with applicable pricing rules. Where Dutch rules apply, an announced discount will generally be based on the lowest price DOXAVIA charged for the relevant product during the preceding 30 days, subject to applicable legal exceptions.
If a price or offer is personalized to you on the basis of automated decision-making and applicable law requires this to be disclosed, DOXAVIA will inform you before purchase.
Obvious pricing, technical or display errors may be corrected to the extent permitted by applicable law.
6. Orders and formation of the agreement
Adding a product to your shopping cart does not reserve that product and does not by itself create a purchase agreement.
Before placing an order, you will have the opportunity to review the information entered and, where the checkout permits, correct errors.
After you submit your order, you will receive an electronic confirmation.
The point at which a binding purchase agreement is formed is determined by the applicable checkout process, the information presented during that process and applicable law.
DOXAVIA may refuse or cancel an order where there is a legitimate reason to do so, for example where a product is unavailable, payment cannot be processed, there is an obvious pricing or technical error, there are reasonable indications of fraud, or fulfilment would be unlawful.
Where DOXAVIA validly cancels an already-paid order and no delivery takes place, amounts that must be refunded under applicable law will be reimbursed.
DOXAVIA may contact you where additional information is reasonably necessary to process your order.
7. Payment
Available payment methods are displayed during checkout.
You must provide valid and accurate payment information and must be authorized to use the selected payment method.
Payment services may be provided by third parties, including Shopify Payments, PayPal or other providers made available through our checkout.
Those providers may apply their own terms and privacy practices to the payment services that they provide.
DOXAVIA will not ask you to provide payment information outside the authorized checkout or payment processes used by our store unless there is a legitimate and clearly communicated reason.
8. Cancellation before fulfilment
Where available, you may submit an electronic cancellation request through your DOXAVIA customer account before an item has been fulfilled:
Whether an order can still operationally be stopped depends on its fulfilment status.
If an order has already been fulfilled or dispatched, this does not remove any statutory right of withdrawal that you may have.
Further information is available in our Return and Refund Policy.
9. Shipping and delivery
Information about shipping destinations, shipping charges, fulfilment, delivery and tracking is provided in our Shipping Policy and, where applicable, during checkout.
Depending on the product, an order may physically be shipped by DOXAVIA, a fulfilment partner or a supplier acting on behalf of DOXAVIA.
Some products may therefore be shipped directly by a third party or from a location different from DOXAVIA's business address.
Where relevant or legally required, information about shipping origin, fulfilment arrangements and expected delivery time will be provided before purchase.
Regardless of who physically ships an order, DOXAVIA remains the seller and your contractual point of contact for the purchase.
Mandatory consumer rules relating to delivery times, risk during transport, damaged goods and non-delivery remain fully applicable.
Where applicable consumer law so provides, DOXAVIA remains responsible for the risk of loss or damage during transport until you, or a third party designated by you, physically receive the goods.
10. Product availability
Product availability may change.
If, after receiving an order, DOXAVIA discovers that an ordered product cannot be supplied, we will inform you as soon as reasonably possible.
Where an order must therefore be cancelled, amounts that must be refunded under applicable law will be returned through the original payment method or another method agreed with you.
DOXAVIA will not substitute an unavailable product with a materially different product without your agreement.
11. Right of withdrawal and returns
Where you have a statutory right of withdrawal, including rights available to eligible consumers entering into distance contracts in the European Union, those rights remain fully applicable.
Eligible EU consumers generally have 14 days to exercise their statutory right of withdrawal, subject to applicable legal exceptions.
The procedure for exercising withdrawal rights, return periods, return shipping costs, exceptions, refunds and the model withdrawal form are described in our Return and Refund Policy.
DOXAVIA also provides an electronic return and cancellation facility through:
This electronic facility does not prevent you from exercising a statutory right of withdrawal through another legally valid method.
12. Defective or non-conforming products and legal guarantee
Your statutory rights where a product is defective, damaged or does not conform to the purchase agreement are separate from the right of withdrawal.
DOXAVIA remains responsible as the seller for valid statutory guarantee and non-conformity claims in accordance with applicable law.
Consumers in the European Union are entitled to mandatory legal-guarantee rights under EU law and applicable national consumer law.
Under EU rules, goods are generally covered by a minimum two-year legal guarantee from delivery. National legislation may provide additional or longer protection.
For consumers in the Netherlands, statutory guarantee rights are not subject to a fixed maximum period. How long a product must perform as reasonably expected depends on matters such as the type of product, price, information provided about it and the lifespan that a consumer may reasonably expect.
Depending on the circumstances and applicable law, an appropriate remedy may include repair, replacement, price reduction or refund.
Further information is available in our Return and Refund Policy.

13. Customer accounts
Certain features may be accessible through a DOXAVIA customer account.
You are responsible for maintaining appropriate security over your email account, devices and authentication methods used to access your customer account.
You must not knowingly use another person's account without permission or intentionally provide false or misleading account information.
DOXAVIA may take reasonable security measures to protect customers, accounts and systems against fraud, misuse and unauthorized access.
Where reasonably necessary, access to an account may temporarily be restricted where legitimate security or fraud concerns exist, to the extent permitted by law.
14. Acceptable use of the website
You may not use the DOXAVIA website or related services:
- for unlawful or fraudulent purposes;
- to obtain unauthorized access to accounts, systems or data;
- to introduce malware, harmful code or other harmful technology;
- to interfere with the availability, operation or security of our website;
- to unlawfully impersonate another person or organization;
- to unlawfully collect or misuse personal data;
- to infringe intellectual-property rights belonging to DOXAVIA or another party; or
- in another way that violates applicable law.
DOXAVIA may use reasonable technical and security measures to protect customers, the online store and our infrastructure against abuse and security threats.
15. Intellectual property
Unless otherwise stated, intellectual-property rights relating to the DOXAVIA name, branding, original website content, graphics, designs and other original materials belong to DOXAVIA or are lawfully used under license.
You may use the DOXAVIA website for normal personal shopping and informational purposes.
You may not reproduce, commercially exploit, distribute or modify protected DOXAVIA content without permission except where permitted by applicable law.
Third-party trademarks and other intellectual-property rights remain the property of their respective owners.
16. Reviews and customer-submitted content
Where DOXAVIA allows customers to submit reviews, photographs, comments or other content, such content must be truthful, relevant and lawful.
You may not knowingly submit fake reviews, misleading information, unlawful content or content that infringes another person's rights.
Where DOXAVIA publishes reviews, we will comply with applicable transparency and review-authenticity requirements and, where required, explain how the origin or authenticity of reviews is verified.
By submitting content to DOXAVIA, you confirm that you have the necessary rights to provide it.
To the extent a license is required for DOXAVIA to display, manage or promote content submitted by you within the relevant feature, you grant DOXAVIA a non-exclusive license limited to what is reasonably necessary for that purpose and to the extent permitted by law.
17. Third-party services and links
The DOXAVIA online store may use or link to services supplied by third parties, including payment providers, carriers, fulfilment partners and technology providers.
A link to a third-party website does not mean that DOXAVIA controls all content, products or services made available by that third party.
Where a third party provides a separate service directly to you, that third party's own terms may apply to that specific service.
This does not reduce or remove any responsibility that DOXAVIA has as the seller under mandatory consumer law.
18. Relationship with Shopify
DOXAVIA uses Shopify as the technology platform that enables us to operate our online store and provide certain ecommerce functionality.
A purchase through the DOXAVIA online store is made directly between you and DOXAVIA.
DOXAVIA is the seller and your contractual point of contact for products purchased from us.
Shopify is not the seller of DOXAVIA products and does not become a party to the purchase agreement between you and DOXAVIA merely because our online store uses Shopify technology.
Certain Shopify services may process information or provide functionality necessary to operate our online store.
More information about processing of personal data through Shopify and other service providers is available in our Privacy Policy.
19. Liability
DOXAVIA does not exclude or restrict liability where doing so is prohibited by applicable law.
Nothing in these Terms excludes mandatory consumer rights or liability that cannot legally be excluded.
To the extent permitted by law, DOXAVIA is not responsible for losses caused exclusively by circumstances outside our reasonable control where such liability may legally be excluded or limited.
Any limitation of liability in these Terms applies only to the extent that it is legally valid for the customer and transaction concerned.
Nothing in these Terms restricts statutory rights or remedies concerning defective, unsafe, non-conforming, undelivered or incorrectly supplied goods.
20. Events outside our reasonable control
Circumstances outside our reasonable control may occasionally affect our ability to perform our obligations.
Examples may include significant transport disruption, natural disasters, government measures, major telecommunications or infrastructure failures and comparable exceptional events.
Where such circumstances affect an order, DOXAVIA will take reasonable steps to reduce their impact and inform affected customers where appropriate.
Mandatory rights relating to delivery, cancellation, withdrawal, guarantee and refunds remain unaffected.
21. Privacy and personal data
DOXAVIA processes personal data in accordance with applicable privacy and data-protection law.
Information about what personal data we collect, why we process it, with whom data may be shared and what rights are available to you is provided in our Privacy Policy.
Our online store uses Shopify and may use additional service providers for website functionality, order processing, payments, fulfilment and other business functions.
22. Complaints and customer service
If you have a complaint about an order, our service or another matter relating to DOXAVIA, contact:
For complaints or requests specifically relating to returns, withdrawal, defective products, statutory guarantee matters, cancellations or refunds, contact:
We aim to handle complaints carefully and within a reasonable period.
This complaints process does not restrict any statutory consumer rights available to you.
If DOXAVIA becomes affiliated with a recognized alternative dispute-resolution scheme in the future and applicable law requires us to provide information about it, that information will be published clearly on our online store.
23. Changes to these Terms
DOXAVIA may update these Terms from time to time, for example because of changes in our business, services, technology or applicable law.
The Terms applicable to a purchase are the terms applicable to that transaction under applicable law.
Later changes to these Terms do not retroactively remove mandatory rights or alter an existing consumer agreement where doing so is not legally permitted.
24. Severability
If a provision of these Terms is found to be wholly or partly invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law.
An invalid provision will be interpreted or adjusted only to the extent necessary and legally permissible.
25. Language and interpretation
DOXAVIA may make these Terms available in multiple languages.
Different language versions are intended to express materially the same rights and obligations.
If a provision is unclear or capable of more than one interpretation, it will be interpreted in accordance with applicable law and mandatory consumer-protection rules.
No language version restricts rights available to you under mandatory law.
26. Governing law and disputes
These Terms and purchase agreements with DOXAVIA are governed by the laws of the Netherlands to the extent that this choice of law is legally permitted.
If you are a consumer, this choice of law does not deprive you of mandatory consumer protections provided by the law of your country of habitual residence where those protections apply.
Nothing in these Terms requires a consumer to bring proceedings exclusively before a Dutch court where applicable law gives that consumer the right to bring proceedings before another competent court.
We encourage you to contact DOXAVIA first if a problem arises so that we can attempt to resolve the matter directly.
